Sent by Amy Parker to CSUCI Public Records on December 13, 2023, and denied by Officer Robertson on December 20, 2023 based on claims that no responsive records exist (which we find unlikely), and that if responsive records existed, they would be exempt under the deliberative process privilege (which we contest, as police texts are generally not considered to be deliberative administrative actions), the balancing test (which we contest, as no explanation for why the public interest would be outweighed toward nondisclosure), and the law enforcement records exception (which does not apply, as only certain types of records are exempt [“opt-in” instead of “opt-out”]).
